CLUBHOUSE USE

Statement of Policy

It shall be the policy of this Homeowners Association that the Clubhouse, having been maintained by members of Fairway Springs Homeowners Association, will only be utilized by those members, their guests, and tenants.  Any owner who is ninety (90) days delinquent on his dues may be denied access to the Pool and Clubhouse at the discretion of the Board of Directors.  This shall include his guests and tenants.  All use of the Clubhouse and special use of the Pool shall be coordinated with the chairman of the Clubhouse and Pool Committee.  The Clubhouse may be used under special circumstances as voted upon by the Board of Directors.

The Clubhouse shall not be used for church services.

Individuals not members of the Association, except those covered by the Declaration of Covenants, conditions and Restrictions, are exempt from all Clubhouse activities (Article IV, Section 4.02).

A charge of forty dollars ($40.00) will be required for use of the Clubhouse.  In addition, a security deposit of one hundred dollars ($100.00).  This deposit will be refunded if the Clubhouse is left clean and undamaged.  The member reserving the Clubhouse will be held responsible for any damage to the building or furnishings and shall sign a contract to that effect.

The member reserving the Clubhouse shall be given a copy of the Clubhouse Rules and Restrictions at the time of reservation.

Private use of the Clubhouse does not include use of the pool.

The duration of the private use shall be four (4) hours, including time for cleanup.

The Clubhouse must be closed and locked by 11:45 p.m., including time for clean up.

Bathing suits, bare feet, and wet clothes are not proper Clubhouse attire.  A sign will be posted in the near future.

Except for special circumstances and only with the approval of the Board of directors are nonmembers, including resident nonmembers, and their guests permitted access to the Pool and/or Clubhouse.

Smoking will not be permitted in the Clubhouse.

Resident nonmembers cannot rent the Clubhouse for personal use.

The Clubhouse may be used without cost for a memorial service or funeral of a deceased member in good standing.  Guests and resident nonmembers may attend.

The Association will permit, but not sponsor, youth activities in the Clubhouse and Pool area provided there is adequate parental supervision and participants are valid members of the Association.  For water safety classes, the instructor must be properly certified.

At the request of the Pasco County Supervisor of Elections, the Clubhouse may be used as a voting polling site, subject to the proviso that there is limited parking available.

Motion carried this date of $100 annually for the upkeep of the clubhouse library, subject to annual review.

Permission was granted for use of the Clubhouse once per week by a Girl Scout Brownie Troop which will be under the adult supervision of a resident member.

The Clubhouse can be reserved for private use by members in good standing and their invited guests.  Preferred use would be for birthday or anniversary parties, wedding receptions, etc.  Prohibited would be use by outside organizations, including religious groups, office parties, sales organizations, etc.  The Board of Directors reserves the right to deny use if it deems inappropriate.

It shall be the policy of this Association that all common areas of Fairway Springs, including the Clubhouse, Pool, and Parking Areas accessible only to members of Fairway Springs Homeowners Association, and their house guests and tenants.  Any member who is ninety (90) days or more delinquent on payment of dues may be denied access.  Resident nonmembers of the Association, and their families, are denied access to the common areas, Clubhouse, Pool, and Parking Area at all times.  Exceptions are listed below:

  1. The Parking Area is accessible for all school children, including nonmembers, for school bus pickup and return purposes only.
  2. Precinct voting.
  3. The Clubhouse may be used for a memorial service for a deceased Association member.
  4. The Clubhouse may be reserved by an Association member for a private party, for which there is a restriction on attendance of up to 120 persons, as mandated by the Pasco County Fire Marshal.

Groups sponsored by Association members may invite nonmember persons as speakers, instructors, or entertainers.  Association-sponsored groups which include members who are not residents of Fairway Springs or are nonmembers of the Association, such as golf leagues and bowling leagues, may not use the Clubhouse facilities for meetings, banquets, or any event at which nonmembers would be in attendance.  It shall be the responsibility of the officers and members of the Board of Directors to strictly enforce this policy.

A member in good standing whose marital status is “single”, that is, divorced, widowed, or not yet married, may bring as a guest a member of the Association or a non-resident of Fairway Springs to any social function sponsored by an Association-authorized social group.  The Board of Directors must approve any exceptions to the above rule.

Immediate family members, that is, parents, brothers, sisters, children, and grandchildren of a member of the Fairway Springs Homeowners Association in good standing may reserve the Clubhouse for a private party.  In this case, the member would be making all arrangements and paying the necessary charges.  In addition to the above, the member’s family could also make the arrangements and pay the necessary charges if they wanted to use the facility for a private surprise party for an Association member.

A member shall not be permitted to reserve the Clubhouse for the use of any non-family-related person or persons who are not members even though that member may be invited to the event.

Any exceptions to the above may be presented to the Board for a ruling.  Each case would be decided separately.

Clubhouse use for private parties does not include the use of any equipment located in the office—namely, the cassette deck and amplifier, which are a part of the Association Public Address System.  The office will be closed and locked during all private parties.

Thermostats are set at 70 degrees in cooler months and at 78 degrees in warmer months.  Any changes to be made will be done by the Clubhouse director.

The sum of one hundred dollars ($100.00) will be given at least 14 days prior to the date of reservation of the Clubhouse as a security deposit to be applied, if necessary, to cover any cleaning costs or damages.  If damage is determined, Clubhouse Director may deduct partial or total refund after inspection. 

The use of the Clubhouse will not include use of the swimming pool.  Reservations of the clubhouse shall be limited to an eight (8) hour period, including set up and clean up.  No functions may be held after 11:00 p.m.  Any additional time needed will be at the discretion of the clubhouse director.

User understands and agrees that use of the clubhouse pursuant to this agreement shall be restricted to the private use of members, their relatives, and guests for such activities as birthday or anniversary parties or small wedding receptions and shall not include business related activities as office parties, meetings, or parties of other organizations, political gatherings, or sales representations.

User agrees that there will be no posters, banners, decorations, etc. affixed to the clubhouse walls.

This agreement is not binding until accepted by an authorized director of the association.

Social Club “garage sales” are allowed to charge $5 per table and resident participants at their homes can be charged $3.

One (1) or two (2) day garage or yard sale one (1) time per year.

There will be no charge when a director is using the clubhouse for a committee function.

Policy was established on rules for the use of the clubhouse television as follows:
Cable television will be installed, but no satellite dish is to be installed.   TV would be used for children’s’ events:  Saturday afternoon movies, social gatherings, etc.

An addendum to the reservation form for clubhouse use shall include a statement of responsibility for the television use for association members, to include a notation stating if Pay Per View is or is not used.

There is no longer availability for pay-per-view television programming at the clubhouse.

A member in good standing may bring, as a guest, a member of the Association or a non-resident of Fairway Springs to any social function sponsored by an Association-authorized social group.  This supersedes policy revision dated 5/26/94.

Effective October 1, 2006, a charge of one hundred dollars ($100.00) will be required for use of the Clubhouse.  In addition, a security deposit of two hundred dollars ($200.00) will be required.  The security deposit will be refunded if the Clubhouse is left clean and undamaged.  The member reserving the Clubhouse will be held responsible for any damage to the building or furnishings and shall sign a contract to that effect.

Effective February 1, 2011, a charge of twenty-five dollars ($25.00) will be required for the USE of the FSHOA Clubhouse by any resident member in good standing.  In addition, a security deposit of seventy-five dollars ($75.00) will be required.  The security deposit will be returned IF the terms of the usage contract are met upon inspection following the event.
The contract, signed by the member intending to use the FSHOA clubhouse, will also include a clause that states that the member “ WILL BE HELD LIABLE FOR ANY AND ALL ADDITIONAL DAMAGES WHICH THE FAIRWAY SPRINGS HOMEOWNERS ASSOCIATION INC MAY INCUR AS A RESULT THEREOF, TOGETHER WITH ATTORNEY FEES AND ALL OTHER COSTS OF COLLECTION.”

Members may park their car (or their guests car) overnight in the Clubhouse parking lot if the following criteria are met:
a)         Requesting member must be in good standing with FSHOA.    
b)         Requesting member must obtain a permit prior to parking any car in the Clubhouse parking lot.  Permits are available from any board member.
c)         Permit must be displayed in vehicle front windshield (or where bystanders can easily observe) while parked in lot.
d)         Parking in the Clubhouse parking lot is limited to 7 days/nights unless special arrangements are made through a board member.
If a permit is not displayed/obtained, the vehicle may be towed and/or reported to the county as an abandoned vehicle left on private property.
